These Terms of Service ("Terms") govern your access to and use of the Los Guerra Cleaning website, mobile applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Overview & Definitions

Los Guerra Cleaning ("we," "us," or "our") operates a technology platform that facilitates residential and commercial cleaning services, including quoting, scheduling, dispatching, messaging, photos, and billing.

You may be:

A Customer requesting or managing cleaning services, or
A Cleaning Professional performing cleaning services through the platform.

2. Eligibility & Accounts

You must be at least 18 years old.
You must provide accurate, current account information.
You are responsible for all activity under your account and for safeguarding your credentials.
We may suspend or terminate accounts for violations of these Terms, security concerns, or legal compliance.

3. Quotes, Pricing & Service Confirmation

Quotes

All quotes are estimates only.
Quotes are based on information provided and observable conditions.
Quotes are not binding until accepted and a service is confirmed.

Service Confirmation

A service is confirmed only when:

The Customer accepts the quote, and
A Cleaning Professional is assigned or dispatched.

4. Payments, Charges & Refunds

Payments are processed by third-party processors.
We do not store full payment card numbers.
Applicable taxes and fees may apply.
Refund eligibility is determined based on service status, timing, and documentation (photos, checklists, messages).

5. Cancellation & Rescheduling

Customers

Cancellation windows and fees are disclosed at booking.
Late cancellations or no-shows may result in charges.
Repeated cancellations may restrict future bookings.

Cleaning Professionals

Failure to accept, arrive, or complete assigned jobs may result in reduced access, payment adjustments, or termination.

6. Customer Responsibilities

Customers agree to:

Provide accurate service details and access instructions
Maintain a reasonably safe work environment
Secure pets, valuables, and hazardous materials
Report issues promptly through the Service

7. Cleaning Professional Responsibilities

Cleaning Professionals agree to:

Perform services professionally and lawfully
Follow job instructions, checklists, and safety requirements
Accurately report job status and upload required photos
Maintain any required onboarding or verification credentials

8. Independent Contractor Classification

Cleaning Professionals are not employees of Los Guerra Cleaning.
Cleaning Professionals operate as independent contractors or are employed by third-party cleaning entities.
Los Guerra Cleaning does not control how services are performed, only the job requirements and platform rules.

Cleaning Professionals are responsible for:

Their own taxes, insurance, licenses, and permits
Compliance with labor, employment, and tax laws
Their tools, equipment, and transportation

Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship.

9. Communications

By providing contact information, you consent to receive service-related emails, SMS, and notifications. Marketing communications require separate consent and include opt-out options. Message and data rates may apply.

10. Acceptable Use

You may not misuse the Service, interfere with operations, upload malicious content, or engage in unlawful conduct. Violations may result in immediate suspension.

11. Content & Records

You retain ownership of submitted content. You grant Los Guerra Cleaning a non-exclusive, royalty-free license to use such content to operate, support, audit, and improve the Service.

12. Location Services

Location data may be used during active jobs to support routing, verification, and dispute resolution. Permissions are controlled through your device settings.

13. Third-Party Services

Third-party providers support payments, messaging, and analytics. Their terms apply independently. We are not responsible for third-party services.

14. Intellectual Property

All Service software, branding, and platform content are owned by Los Guerra Cleaning or its licensors and are protected by law.

15. Disclaimer of Warranties

The Service is provided "as is" and "as available." All warranties are disclaimed to the maximum extent permitted by Texas law.

16. Limitation of Liability

To the maximum extent permitted by Texas law:

We are not liable for indirect, incidental, or consequential damages.
Our total liability will not exceed the amount paid for the applicable service.

17. Force Majeure

Los Guerra Cleaning will not be liable for delays or failures in performance resulting from events beyond reasonable control, including but not limited to acts of God, natural disasters, extreme weather, fires, floods, pandemics, labor disputes, supply shortages, utility or internet outages, government actions, or transportation disruptions.

CONSPICUOUS NOTICE - WAIVER OF JURY TRIAL AND CLASS ACTION

THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION. BY ACCEPTING THESE TERMS, YOU AGREE THAT ALL DISPUTES WILL BE RESOLVED BY FINAL AND BINDING ARBITRATION AND NOT IN A COURT OF LAW.

YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

18. Arbitration Agreement & Governing Law (Texas)

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, any booking, payment, cancellation, refund, or the relationship between you and Los Guerra Cleaning (collectively, "Disputes") shall be resolved by final and binding arbitration, rather than in court.

Arbitration Administrator

Arbitration shall be administered, at the election of the party initiating arbitration, by one of the following:

American Arbitration Association (AAA) under its Consumer Arbitration Rules or Commercial Arbitration Rules (as applicable), available at www.adr.org, or
Judicial Arbitration and Mediation Services (JAMS) under its Comprehensive Arbitration Rules, available at www.jamsadr.com.

If neither AAA nor JAMS is available, the parties shall mutually agree on a comparable arbitration provider.

Location & Law

Arbitration shall take place in the State of Texas, unless the parties agree otherwise.
These Terms and the arbitration shall be governed by:
- The Federal Arbitration Act (9 U.S.C. § 1 et seq.), and
- The laws of the State of Texas, without regard to conflict-of-law principles.

Individual Basis Only

Arbitration shall be conducted on an individual basis only.
Class actions, collective actions, private attorney general actions, and representative proceedings are expressly waived.
The arbitrator may not consolidate claims or award relief to anyone other than the individual party.

Costs

Each party shall bear its own attorneys' fees and costs unless otherwise required by applicable law or the arbitration rules.
Arbitration fees will be allocated in accordance with the selected administrator's rules and applicable law.

Authority of Arbitrator

The arbitrator has exclusive authority to resolve:

Any dispute regarding the interpretation, applicability, enforceability, or formation of this Arbitration Agreement, and
Any claim that all or part of this Arbitration Agreement is void or voidable.

Judgment

Judgment on the arbitration award may be entered in any court of competent jurisdiction.

19. Termination

You may stop using the Service at any time. We may suspend or terminate access for violations, security risks, or legal requirements.

20. Changes to These Terms

We may update these Terms periodically. Material changes will be posted with an updated effective date. Continued use of the Service constitutes acceptance.
